Terms of Use and Privacy Policy of Starry Online Shop
1. General terms

These Terms of Use of Starry Online Shop (hereafter: Online Shop) apply when making a purchase or registering a client account in the Online Shop. The seller of the products (hereafter: seller) is Ilukaubad OÜ. Legal address Sõpruse pst 33-1 Tallinn, 10615 Estonia. Registry code 12026973, VAT: EE101450601. The terms apply to all legal relations arising through the purchase of products from Online Shop between all persons (hereafter: client) and the seller. The seller has a right to unilaterally change and renew the terms, publishing the new terms at https://www.starrylashes.com.

The client is able to familiarize himself with the conditions prior to the purchase and the client has to agree to the Terms of Use and Privacy Policy when purchasing from the Online Shop. In addition, the applicable laws in the Republic of Estonia apply when purchasing from the Online Shop.

2. Ordering
2.1. Placing an order

Orders can be placed by registering and logging in to the client account or without logging in. The client chooses the products from the online shop and adds them to the shopping cart. On the checkout page, the client fills out the necessary fields (first and last name, e-mail, telephone, company name, and address), chooses a shipping and payment method, and places the order.

2.2. Taxes and ordering with 0% Value Added Tax (VAT)

Prices displayed by default in the Online Shop include an Estonian VAT (22%). The VAT changes when the client's shipping address is outside the seller's country (Estonia). 

Shipping to another European Union country.

Prices contain the standard VAT of the destination country for both private persons and companies without a VAT number. The prices with VAT are the same for all private persons ordering inside the EU economic area.

Companies with a valid VAT number order with 0% VAT.

The VAT is deducted from the prices automatically after filling in the VAT field on the checkout page with a valid VAT number. We use VIES VAT number validation to verify the validity of your VAT number.

Shipping outside the European Union.

When the shipping address is outside the EU economic area, prices are VAT-exempt and the VAT is displayed at 0%. The VAT is deducted on the checkout page after choosing the shipping address country. Customs duties and taxes are applied by the destination country based on the recipient's customs regulations. All added duties and taxes are the responsibility of the client.

Ordering with 0% VAT to another European Union country.

1. Add products to the shopping cart and proceed to checkout.
2. Type in your shipping address information and fill in the "VAT number validity" field with your VAT (Value Added Tax) number. Do not forget to include the country code (e.g "SE999999999901" for Sweden).
3. The VAT number is automatically checked.
4. If the VAT number is valid, the VAT is deducted and the Tax is shown as 0%.
5. Finish your order by choosing a suitable shipping and payment method.

2.3 Payment methods

The seller will ship all orders after receiving full payment of the order. 

The client pays for the products during the checkout process in the payment environment provided by the seller or makes the payment later by bank transfer according to the invoice sent to the client’s email. 

Payment in cash or by debit card is possible only when the client chooses to pick up the order from the Starry shop in Tallinn. 

The sales contract between the seller and the client is in full force after the seller receives the full payment through the payment environment or to the seller’s bank account.

All payments sent to the seller's bank account shall be in Euros. The Online Shop may change prices at any time. 

Seller reserves the right to refuse any order placed through the Online Shop and will refund the payment if the payment is made for the order. The seller may limit or cancel quantities purchased per person, per household, or per order.

2.4 Shipping and delivery

The seller will ship all orders after receiving the full payment. Orders are shipped on business days (Mon-Fri). Orders placed on Estonian Public Holidays are shipped on the next business day. 

Orders paid on a business day before 14.00 (GMT+2) are usually shipped on the same day. 

In case there is an unfortunate error (stock quantity mistake, quality problem, etc) with the ordered products, the seller will contact the client to agree on the replacement or compensation.

2.5 Refunds, returns and exchanges

All products ordered from Starry Online Shop are eligible to exchange or return for 30 days from receiving the order. 

To exchange or return a product the client needs to send an email with an explanation of the defect or problem and a desirable solution to info@starrylashes.com. Requests can also be made by phone (+37258868733) or in the Starry shop at Laki 4, Tallinn, Estonia.

The seller refunds the amount of the returned products together with the original shipping fee within 14 days from the date the products arrive back at the seller's address. In the case of an exchange, the seller will send a new product to the client within 5 business days after the product being exchanged has been returned to the seller's address (Starry shop, Laki 4, Tallinn, 10621, Estonia).

The shipping costs of returned products are paid by the client unless a wrong or defective product has been sent to the client.

The right to return and exchange does not apply to products that are unusable due to hygiene reasons. 

2.6 Settlement of disputes

The seller does not take responsibility for the consequences of incorrect data provided by the client when placing an order. The seller is not responsible for any damage caused by product misuse (use that is different from the product instructions).

Disputes arising between the seller and the client are resolved by negotiation between the parties. In case an agreement is not reached, the client has the right to contact the Estonian Consumer Protection Board (Endla 10A, 10122 Tallinn, http://www.tarbijakaitseamet.ee) and the Consumer Dispute Committee (Endla 10A, 10122 Tallinn, https://ttja.ee/tarbijavaidluste-komisjon) to settle the dispute out of the court or to Harju county court. In addition, all clients have the opportunity to reach out to the EU electronic ODR-platform (Online Dispute Resolution) which solves disputes with all online sellers at http://ec.europa.eu/odr

3. Privacy Policy
3.1 Collection and processing of the personal data of the client

The Seller uses the client’s personal data in accordance with the requirements of the General Data Protection Regulation (GDPR). The seller collects personal information when registering an account in the online shop and / or when the client places an order. The seller collects personal information that is inevitably needed for completing orders in the online shop and for contacting the client.

Collected personal data is data that is requested from the client when registering an account and / or ordering:

  • First and last name
  • Telephone number
  • Email address
  • Company name
  • Shipping address (street, apt. number, city, zip code, country)
  • Payment method
  • Shipping information

The seller uses the collected personal information to:

  • Complete orders submitted in the Online Shop
  • Send messages related to the order
  • Send newsletters and customer offers with the client's prior consent.

The seller also has the right to use the personal data collected to better understand the client's expectations.

3.2 Changing and updating personal data

The information provided when registering an account is available to the client to see, change, and delete when logging in to the online shop’s My Account environment. With the permission of the client, the data can also be changed by the Online Shop’s employees.

If the client has requested to receive newsletters and / or personal offers, the client will always have the right to cancel them by sending an email to info@starrylashes.com or by clicking the unsubscribe link at the end of a newsletter.

3.3 Storing personal data

Personal data is stored as long as it is necessary to fulfill the specific purpose for which personal data is processed. Due to the obligation to organize accounting, personal data reflected in accounting documents are stored for up to 7 years.

3.4 Protection of personal data

Personal data provided by the client is processed in accordance with the relevant European Union legislation and the laws of the Republic of Estonia. The seller applies all precautionary measures to protect the client's personal data. Access to data processing is restricted to authorized persons.

The seller does not forward the customer's personal information to third parties, except service providers, with whom cooperation is needed to complete the purchase from the online shop and the delivery of the order to the client (payment solutions, postal and courier companies, accounting services).

The data is forwarded to the respective parties to the extent minimally necessary to provide the relevant service.
